Terms and Conditions for the Web Host Election

1. Participants, Disqualification from the Contest & Voting
   Participation is open to persons aged 18 and over residing in Germany or Austria. To participate in the contest and voting, it is essential that the email address provided is truthful. Employees of hosttest, their affiliated companies, and contest partners (this explicitly refers to all hosting providers represented on hosttest) including relatives of the aforementioned groups are excluded from participation. Hosttest is entitled to exclude individuals from participation if there are justified reasons, such as violation of the terms and conditions, unauthorized influence on the contest, manipulation of the election, multiple participation, etc. In such cases, prizes may also be reclaimed retroactively. The votes cast in this case will not be counted.
   
2. Furthermore, companies participating in the election are prohibited from rewarding their own prizes/raffles/discounts/vouchers for voting for their company.


3. Conditions of Participation
   Only participants who have cast a vote in the annual web host election and agreed to participate in the contest will be considered for the raffle. The winners will be determined by lot, ensuring the principle of randomness. Each participant can only win one prize. Cash payment or transfer of the prize to other persons is excluded. The winners will be notified via the provided email address after the end of the raffle. If a winner does not respond within 7 days of notification, the claim to the prize will expire. After this period, the prize can be awarded to another participant. The participant is responsible for the accuracy of the provided address. The announcement of the winners is without guarantee.
   


4. Changes to the Terms and Conditions and Termination of the Contest & Voting
   Hosttest reserves the right to change the terms and conditions at any time. Furthermore, Hosttest reserves the right to terminate or interrupt the contest at any time for important reasons without prior notice and to not raffle individual prizes that were not provided by sponsors.
   


5. Limitation of Liability
   Hosttest's liability - regardless of the legal reason - exists only if a damage was caused by culpable violation of a contractual obligation (cardinal obligation) in a manner that endangers the achievement of the contract purpose or is due to intent or gross negligence.
   


6. Further Use of Participation Data after the Contest
   Your participation data will be used exclusively for the annual contest. There will be no further use of the data after the end of the contest and no transfer of the data to third parties, unless it is for the transmission of the contest prize. The participation data will be deleted after the raffle is completed.

   We expressly point out that Hosttest is not responsible for the content of the linked page by placing a link.
   


8. Deadline
   The deadline for participation is October 20, 2024. The winner determination will take place by November 20, 2024, excluding the public.
   


9. Final Provisions
   Should individual provisions of the terms and conditions be invalid or become invalid, the validity of the remaining terms and conditions remains unaffected. An appropriate regulation that most closely corresponds to the purpose of the invalid provision shall take its place. In all contests, the decision of the judges is final.
