Terms and Conditions for the Web Host Election
1. Organizer
The organizer of the "Web Host of the Year" election and the associated prize draw is Marco Keul, Gerhart-Hauptmann-Str. 5, 33824 Werther (Westf.), Germany (hereinafter "hosttest").

2. Eligibility and Exclusion
a) Participation is open to persons aged 18 and over residing in Germany, Austria, Switzerland, the United Kingdom or Spain. To participate in the prize draw and to vote, a valid email address assigned to the participant must be provided. Votes and prize-draw entries are only taken into account if the email address has been confirmed via the confirmation link that was sent.
b) Employees of hosttest and companies affiliated with hosttest, as well as employees of all hosting providers represented on hosttest, in each case including their relatives, are excluded from participation in the prize draw and from voting. This serves in particular to prevent votes being cast in favor of one's own company.
c) The provision of a prize by a hosting provider has no influence on the election or its outcome and is not taken into account when evaluating the votes.
d) Companies standing for election are prohibited from rewarding or incentivizing votes for their own company through their own prizes, raffles, discounts, vouchers or other benefits.
e) hosttest is entitled to exclude individual persons from participation if there are legitimate reasons, in particular a violation of these terms and conditions, unlawful influence on the prize draw, manipulation of the election or multiple participation. In such cases, prizes already awarded may be reclaimed; the affected votes will not be counted.
f) Anti-manipulation: hosttest reserves the right to exclude votes or participants if there is reasonable suspicion that votes were cast unlawfully using technical means (e.g. bots, scripts or disposable email addresses). Affected votes may in such cases be deleted or not counted.

d) The winners will be notified via the email address provided. If a winner does not respond within 7 days of the notification being sent, the claim to the prize expires and the prize may be awarded to another participant. The participant is responsible for the accuracy and reachability of the email address provided.

5. Amendment and Termination
hosttest reserves the right to amend these terms and conditions, to interrupt or terminate the prize draw and not to raffle individual prizes, provided there is an objectively justified reason for doing so – in particular if legal or technical reasons prevent proper implementation or if promised prizes are not provided by sponsors – and provided that participants are not unreasonably disadvantaged as a result. Votes already cast remain unaffected by changes as far as possible.

b) In the event of a slightly negligent breach of an essential contractual obligation (cardinal obligation) whose fulfilment is what makes the proper conduct of the prize draw possible in the first place and on whose observance the participant may regularly rely, liability is limited to the foreseeable damage typical for the contract.
